Terms of Service

Welcome to BoardPlay ("BoardPlay", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of the BoardPlay website, web applications, classroom games, worksheet generation tools, and related services (collectively, the "Service").
BoardPlay is designed for classroom engagement. Educators hold the accounts, and students do not need accounts or personal data entry to participate in interactive games or use printed worksheets. All services are hosted on infrastructure in the Hong Kong Special Administrative Region (SAR) to deliver fast, direct access globally and within mainland China without third-party tracking CDNs.
1 Acceptance of Terms
By registering an account, accessing, or using the Service, you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you are entering into these Terms on behalf of an educational institution, school, or organization, you represent that you have the authority to bind that entity to these Terms.
2 Accounts & Educator Eligibility
Account creation is restricted to teachers, educators, homeschoolers, parents, and authorized individuals who are at least 18 years of age (or the age of legal majority in their jurisdiction). A valid, unique email address is required to register and maintain an account. Users agree to complete email verification when prompted. You agree to provide accurate, current information upon registration and to safeguard your credentials. You are solely responsible for all activities that occur under your account.
No Student Accounts: Students do not create accounts on BoardPlay. Classroom activities and worksheets are deployed directly by educators via shared interactive displays or anonymous guest session links.
3 Educational Compliance (COPPA, FERPA, GDPR-K, PIPL)
BoardPlay is structured to minimize data collection and respect classroom privacy regulations across multiple international jurisdictions:
- United States (COPPA & FERPA): BoardPlay does not knowingly collect personal identifiable information (PII) directly from children under 13. When educators use the platform in an educational setting, they act as the authorized agent for student engagement in compliance with FERPA and COPPA.
- European Union & UK (GDPR & UK GDPR): We uphold data minimization principles. We do not track student behavioral profiles, run behavioral advertising, or sell educational data.
- Mainland China (PIPL): In accordance with the Personal Information Protection Law of the PRC, personal data processing is restricted to authorized account creation and operational service delivery. No unauthorized biometric, financial, or sensitive student PII is processed.
4 User-Generated Content & Intellectual Property
Educators may upload vocabulary lists, definitions, question pairs, worksheets, and images ("User Content") to generate games and printable materials.
Your Content Warranties:
By uploading any materials (including images and text), you represent and warrant that: (a) you own or possess all necessary rights, licenses, and permissions to use and display the content; (b) your content does not infringe upon any third party's copyright, trademark, privacy, or proprietary rights; and (c) the content is age-appropriate for an educational environment and free from malware.
License to BoardPlay: You retain full ownership of your User Content. You grant BoardPlay a non-exclusive, worldwide, royalty-free license to host, display, resize, optimize, and serve your content solely as necessary to operate the Service and provide printable worksheets and game activities for you and your classroom.
5 Acceptable Use Policy
You agree not to misuse BoardPlay. Specifically, you may not:
- Upload, publish, or distribute content that is defamatory, obscene, pornographic, promoting violence, hate speech, or unlawful material under applicable law;
- Attempt to probe, scan, or compromise server security, reverse engineer server components, or overload our systems through automated scraping, denial-of-service, or abusive request rates;
- Upload executable binaries, scripts, viruses, or circumvent our server-side image compression and upload verification safeguards;
- Use the Service for unauthorized commercial reselling or automated redistribution outside educational contexts.
6 Hosting Infrastructure & Cross-Border Delivery
BoardPlay operates on self-contained server infrastructure physically situated in the Hong Kong Special Administrative Region (SAR). By using the Service from mainland China or other international locations, you acknowledge and consent that account data and uploaded activity assets reside on Hong Kong infrastructure. The Service avoids external CDN dependencies to ensure stable, high-performance direct delivery across international boundaries.
7 Disclaimers & Limitation of Liability
THE SERVICE AND ALL PRINTABLE MATERIALS AND GAMES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOARDPLAY DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
IN NO EVENT SHALL BOARDPLAY OR ITS OPERATORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF DATA, LESSON TIME, PROFITS, OR GOODWILL ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
8 Governing Law & Jurisdiction
These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region (SAR), without giving effect to any choice or conflict of law principles. Any legal suit, action, or proceeding shall be instituted exclusively in the competent courts of Hong Kong SAR.
